By accessing or using YardFlip ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Regan Kirk, operating as YardFlip ("we," "us," or "our"), located in Queensland, Australia.
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.
YardFlip is a mobile application that allows users to create and visualize yard and landscape designs using artificial intelligence technology based on photos uploaded by users.
New users receive 4 free credits upon registration. This trial is intended for first-time users only. Each credit generates one design.
After your free credits are used, additional credits can be purchased:
Starter - $9.99 USD - 14 Credits
Pro - $29.99 USD - 50 Credits
Best Value - $59.99 USD - 120 Credits
YardFlip does not offer direct refunds for credit purchases. All purchases are final.
However, all transactions are processed through the Apple App Store. If you
believe you are entitled to a refund, you may submit a request directly to
Apple through your App Store purchase history. Refund decisions are made
solely by Apple in accordance with their policies.
YardFlip does not offer recurring subscriptions. All credit purchases are one-time transactions.
YardFlip uses Sign in with Apple for account authentication. By signing in, you agree to Apple's Terms of Service. Your Apple ID credentials are managed entirely by Apple and are never shared with or stored by YardFlip.You are responsible for maintaining the security of your Apple ID and for all activities that occur under your YardFlip account.
Creating multiple accounts to obtain additional free credits is strictly prohibited and will result in immediate account termination. This includes but is not limited to:
We reserve the right to suspend or terminate your account at any time if you violate these Terms, including but not limited to:
You may delete your account at any time through the app's profile settings. Upon deletion, your account data will be permanently removed in accordance with our Privacy Policy.
You retain all rights, title, and interest in and to any photos, images, or designs you upload or create using the App ("User Content"). We claim no ownership rights to your User Content.
We may request permission to use your designs for marketing and promotional purposes, including featuring them in advertisements, on our website, or in promotional materials. This is completely optional and requires your explicit consent. You will be presented with a clear opt-in option within the App if we wish to use your designs for marketing purposes. You may withdraw consent at any time by contacting us at [your contact email].
The App, including its design, features, functionality, and all content not provided by users, is owned by YardFlip and is protected by copyright, trademark, and other intellectual property laws.
YardFlip uses artificial intelligence models to generate yard design suggestions. AI technology can be unpredictable and results may vary in quality, accuracy, and appropriateness.
We provide the App and all designs "as is" without any warranties or guarantees of any kind, express or implied. We do not guarantee:
All designs created by the App are for inspirational and visualization purposes only. You must consult with licensed professionals, including but not limited to landscape architects, contractors, and engineers, before implementing any design or beginning any construction or landscaping project.

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We do not sell, rent, or share your personal information or User Content with third parties for their marketing purposes.
If you delete your account or your account is terminated, we will delete your User Content and personal data within 48 hours, except where we are required to retain it by law.
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
We reserve the right to modify, suspend, or discontinue the App or any features at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
You agree to indemnify, defend, and hold harmless YardFlip and Regan Kirk from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Queensland, Australia.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and YardFlip regarding the App and supersede any prior agreements.
